This study is intended to revise and improve the current ‘the Guidelines for Classification and Judgement of Administrative Regulations’ in Korea and to suggest the improved version of the Guidelines with plenty of regulatory cases. In particular, this study is expected to help the working-level officials register the regulations in their fields in more efficient, consistent and systematic way.
For this purpose, this study focuses on improving the three fields: the criterion to judge whether a certain article (or clause) is an administrative regulation; the criterion to classify a regulation as one of economic regulation, social regulation and administrative regulation; and the criterion to judge a registration unit (main regulation and dependent regulation). This work is achieved by analyzing over 5,000 registered regulations and by revising and filling the current criterion in the three categories based on the analysis. As a major advantage of this study, the revised version of the Guidelines covers various regulation cases in accordance with the criterion, which helps the public officials in charge of regulation find, classify and register the regulations more correctly and systematically. However, this kind of revision work needs to be continued on regular basis. We hope this study will eventually provide the solid base for the regulatory reforms in Korea.
