regulation is no more regarded as a tool of government control. Regulation in fact is an important tool of public service. Therefore, the term regulatory
delivery system is frequently used in countries like United Kingdom, U.S.A, and Netherlands where the research of regulatory reform is advanced.
The debate of better regulation extends beyond the quality of regulation.
Better regulation is the process to enhance the quality of legislation and reduce the cost of regulation. The cost of regulation includes the compliance cost, direct government cost, and broader community cost. These costs can be reduced only through improving the regulatory delivery system.
The purpose of this study is to improve efficiency and the responsibility of the regulatory delivery system. Regulatory delivery system includes the right
regulatory structure and post-implementation review system.
The research methods of this study is depth interview, questionnaire survey and literature review. The depth interview was conducted with civil servants
in 7 local governments. The respondents of questionnaire survey were regulatory bureaucrats in central government. The literature review focused on
regulatory structure and review system in United Kingdom, U.S.A., Netherlands, and Australia.
The following is suggested to improve regulatory delivery system in Korea.
First, regulatory delivery system must be consistent and simplified through consolidation and coordination of regulators. By collapsing the total number of regulators into a small number of thematic areas, the burden of the regulatee would be reduced.
Second, information technology could be better used to improve data sharing between regulators. It would improve the communication between the regulator and the regulatee.
Third, the coordination between central and local government is important for effective regulatory delivery system. The institutional setting for the participation of local government in regulatory policy precess has to be prepared.
Fourth, one-stop shop regulatory service which is already use in some local governments has to be diffused to all local authorities.
Fifth, post-implementation review system is the essential mechanism of regulatory delivery system. All regulations should be subject to review processes to ensure their continuing appropriateness and effectiveness. The post-implementation review system has to collaborate with the Board of Audit and Inspection of Korea.
