This research is designed to help understand the controversial issues in the KORUS FTA Investment Chapter and to guide the direction of discussion on such issues. The issues in the Investment Chapter cover the scope of application in the investment chapter, temporary safeguards, the relationship between expropriation and public policy, performance requirement, investor-state dispute settlement, etc. The objective of the Bilateral Investment Treaty (BIT) is to increase foreign investments and to protect investments established between treaty parties. There are currently about 2,500 BITs around the world. In terms of the format of BITs, there are mainly two types. One is to protect investments after they are established and the second is to protect also investments prior to their establishment.
The latter covers investment protection more comprehensively. Korea has currently concluded 81 BITs with many foreign countries, which includes a Korea-Japan BIT that is characteristic of the second BIT type. (The rest omitted)
