C. The Revision of the Capital Market Act in Korea

After a drawn-out discussion on the revision of the Capital Market and Financial Investment Business Act (hereafter, Capital Market Act) of Korea, the proposal passed the legislation at the end of April. Since 2011, the Financial Services Commission (FSC) has pushed on planning the revision bill. The FSC presented the first draft of revision bill including four main issues in November 2011. 1 . (Financial Industry) Propelling development of Advanced Investment Banks 2. (Capital Market) Introducing Alternative Trading System (ATS) and over-the-counter (OTC) CCP 3 . (Corporate) Reflecting related changes in the Commercial Act, providing new tools for raising funds and making shareholders’ meeting substantial. 4 . (Investors) Reinforcing punishment on illegal transaction such as price manipulation. T h e bill includes measures to adapt to the rapidly changing global financial market environment to improve market infrastructure and strengthen consumer protection. Revising the law would help improve efficiency of the capital market and bring about structural reforms in the financial investment industry. Policy-makers and market players are formulating strategies to bolster the capital market and reignite investment, and the proposed bill clearly mirrors their concerns.
