The recent moves to strengthen private information protection in Korea

Frame of Image  n t l y, a number of laws govern management of private information: The Privacy Act, the Credit Information Act, and the Communication Network Act, to name a few. The latter two are special laws, and the Privacy Act prevails unless the special laws have specific provisions on private information protection. However, in practice, it is hard to clearly distinguish between “private information” and “personal credit information” that are regulated by different laws. Even the supervisory authorities are different as they are under supervision of the Ministry of Security & Public Administration, Korea Communications Commission, and Financial Services Commission, respectively. For this reason, there might be areas of redundant supervision or blind spots. Conceptually, all private information collected and used off line are governed by the Privacy Act, all personal credit information collected and used are subject to the Credit Information Act, and private information other than credit information collected and used on line are subject to the Communication Network Act. However, the scope of personal credit information in accordance with the Credit Information Act extends beyond credit data and includes individuals’ identification information.
