Abstract

In recent years, the environment surrounding R&D activities has been dramatically
changing. Due to the growing technological complexity and technological convergence,
it is becoming difficult and inefficient for a company to develop all technologies and
components required for providing new products or services by itself. Thus there are
many interchanges of IPR between researchers, and they are become important process
of R&D. This change brings about alteration of IPR value from temporary monopoly
power granted to IPR owners to just a letter of guarantee for IPR exchange. In a
traditional notion, IPR is expected to play a role as a means for transferring ideas and
technologies from one entity to another, in addition to acting as a means for excluding
others from using companies' own ideas and technologies. But in recent notion, it
plays various roles, and it grows up IP business industry. Since 2000s, we have been
faced with many news related with patent litigation. It means that IP business extends
to litigation model over manufacturing, licensing, etc. Especially, it became a
significant diversion point of recognition about IP business scopes to advent of NPEs
with notorious name as “Patent Troll”.
In this report, we study five types of IP business: IP management, IP trading,
Aggressive IP strategy, Defensive IP strategy, and IP-based financing. IP management
type services on IP strategy advice, patent evaluation, portfolio analysis, licensing
advice, etc. IP trading type supports business models for IP transfer and online IP
auction, TLO, etc. Aggressive IP strategy type includes patent pool, IP licensing, and
NPEs. Defensive IP strategy type is recruiting defensive patent aggregation funds and
presents needs for sharing of eco-patent. And IP-based financing type collects fund
related with innovation.
There will be unpredictable diversified models in future IP business. So we should
prepare strategies to win many value-added in IP business. To do so, first, we should
reform law systems to enhance IP business power. And there need many policy
programs to improve system based on the IP business types, such like training of IP
experts, R&D plan based on IP, advanced technology transfer programs, TLO support,
incentive model, and activating VC based on IP.
In order to promote innovation throughout the entire society in this open innovation
era, enhancing the smooth circulation of IP, notably patents, is critical. In these
circumstances, both public authorities and private IP specialist firms are playing an
important role for facilitating the diffusion of knowledge and technology. In particular,
the activities of IP specialist firms will become more crucial.
