The intervention of the government on housing sector is achieved through means of housing related laws and regulations. Such intervention should be legitimate, efficient, equitable, and flexible in order to cope with the changing circumstances.
The purpose of this study is to amend and revise housing related laws and regulations, so that housing policy objectives, can be put forward effectively. The study consistst of four chapters; introduction, analysis of the housing related laws, inquiry of its problems, and recommendation on improving the housing related laws and regulations.
In the second chapter, analysis of housing related laws, while giving priority to the Housing Construction Promotion Act, it dealt with the general structure of the laws, interrelationship between housing related laws, and the relationship with the administration. Because the structure the structure of housing related laws were partly revised and supplemented the regulations are not only complicated and diverse, but also overlapping and conflicting. These problems are being an obstacle in carrying out effective housing policy.
In the third chapter, the following were examined; definition and claa\ssification of housing, structure of housing finance, housing construction standard, housin supply systme, and development of sites. Based on these analysis, in the forth chapter, recommendatios on improving housing related regulations were made. Suggested recommendations concerning housing related laws are as follows :
First of all, in order to imporve housing condition of the citizen and equitble distribution, a housing indicator should be established. As the future direction of the housing policy will emphasize solving housing problems of the urban poor, minimum housing standard as well as an appropriate housing standard should be arranged.
Secondly, when local autonomy is established, roles between central and local governments should be redifined. Roles regarding formulation of housing construction plan, enforcement of land development plan, implemenatation of public housing constrctuion plan should be divided accordingly.Additionally, in order to reinforce the weak financial status of the local gevernment, public finance should be reasonably distributed and national housing fund should be examined.
Thirdly, the qualification of the housing developer should be ordained more flexibly. The complicated and inflexible housing supply system should be practically revised and eased gradually.
Fourthly, an organization which carry out examining housing defect, defective repaining, and insurance for reducing excessive burden of defect repair should be established.
Lastly, revision on housing related regulation must be made in order to supply for land and housing to particular families. Also, restirctions on housing size, will be able to become relaxed.
On the other hand, amending and reforming only certain aparts of existing laws in order to achieve the goal of housing policy, has its limits. In this study, we suggested to reorganize the housing related laws, and to replace the Housing Construction Promotion Act with Housing Law.
The structure of housing related laws should be formatted into Housing Law, which will take charge as a mother law, and as enforcement regulations. Presidential decree and ministrial ordinances will consist of housing construction, housing supply and management, use of national housing fund, and housing imporvement. Also, it was suggested that Rental Housing Law and Residential Land Development Law should be separately amended to act as a supplement to the Housing Law.
